Nolele Terms of Service

This website is operated by Nolele. Throughout the site, the terms “we”, “us” and “our” refer to Nolele. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

1. Product Safety & Proper Use

By purchasing and using the Swaddle Easy, you acknowledge and agree to follow these federal safety standards and manufacturer guidelines:

  • Magnet Safety & Medical Notice: WARNING: This product contains securely enclosed permanent magnets. If fabric is compromised or magnets become exposed, discontinue use immediately. Swallowed magnets can stick together across intestines, causing serious infections, organ damage, or death. Medical Interference: Keep this product away from implanted medical devices such as pacemakers or similar equipment.

  • Safe Sleep Standards (Non-Weighted): The Swaddle Easy is a non-weighted sleep product. In accordance with CPSC and AAP guidelines, do not use this product in combination with weighted blankets or other weighted sleep aids, as these can restrict an infant's breathing and increase the risk of suffocation.

  • Positional Safety & The Rolling Milestone: Always place baby on their back to sleep on a firm, flat surface. Discontinue swaddling (securing arms inside) immediately at the first sign of baby attempting to roll. Continued use after rolling begins increases the risk of injury. In "Arms Out" mode, do not place the baby face down; it is intended for supervised feeding, playtime, and face-up sleeping.

  • Flammability & Snug Fit: Crafted from 100% Organic Cotton, this garment is not flame resistant. For safety, the garment must always fit snugly. Loose-fitting garments are more likely to catch fire. Ensure correct sizing based on our Sizing Table.

  • Travel System & Harness Use: If used in a stroller, bouncer, or travel device, follow the device manufacturer’s instructions. Ensure the harness fits snugly and is properly positioned. Do not place additional padding or thick layers behind the infant or under harness straps.

  • Temperature & Overheating: Caregivers must monitor for signs of overheating (sweating, damp hair, flushed skin). Avoid excessive layering underneath the garment.

  • User Responsibility & Inspection: You agree to inspect the garment for damaged seams, torn fabric, or exposed magnets before every use. Nolele is not responsible for injuries resulting from the use of a damaged, modified, or improperly sized product.

2. Limitation of Liability

To the maximum extent permitted by applicable law, Nolele, Inc.'s, directors, officers, and employees total liability for any claim arising from purchase or use of this product shall not exceed the original purchase price paid by the customer. Nolele, Inc. shall not be liable for any indirect, incidental, special, or consequential damages. This includes, but is not limited to, any damages resulting from:

  • Misuse or failure to follow safe sleep and product instructions.

  • Use of the product once the infant has reached the rolling milestone.

  • Use of a product that shows signs of wear, damage, or exposed magnets.

  • Interference with medical devices. You assume all responsibility for the safe use of the product.

This limitation applies regardless of the theory of liability. Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

3. Accuracy of Billing and Account Information

We reserve the right to refuse any order. We may attempt to notify you of order changes or cancellations via the email or billing address provided.

4. Returns and Refunds

Our return policy is strictly 30 days from the date of delivery. Items must be in original packaging, unwashed, and unworn. Due to hygiene standards for baby products, we cannot accept returns on items that have been used or laundered.

5. Mandatory Safety Communications

By purchasing, you agree that we may contact you via email for critical safety alerts or product recalls. These communications are mandatory for consumer safety and are not considered marketing "opt-ins."

6. Intellectual Property

All content, including text, logos, images, and the Swaddle Easy magnetic design, is the property of Nolele and protected by United States and international copyright, trademark, and patent laws.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Hennepin County, Minnesota.

8. Disclaimers

  • This product does not prevent SIDS.

  • This product is not a sleep positioner, medical device, or monitoring device.

  • Individual sleep outcomes are not guaranteed.

  • Caregivers remain solely responsible for ensuring the sleep environment meets safe sleep recommendations.
